SMS/Text Message Marketing Terms and Conditions

Program name: VitaTienda SMS Marketing Program.

Overview: VitaTienda.com ("VitaTienda", "we", "us", or "our") offers a mobile messaging program (the "Program"), subject to these SMS Terms and Conditions. By opting in to the Program you agree to these terms. We may modify or cancel the Program or any of its features without notice, and to the extent permitted by applicable law we may also modify these SMS Terms at any time.

Opt-In and Consent

By providing your mobile phone number and opting in to the Program — for example by checking the SMS consent box at checkout — you expressly consent to receive recurring automated marketing and promotional text messages (such as cart reminders, promotional offers, special discounts, product updates, and health and wellness tips) from VitaTienda at the mobile number you provided. You also consent to receive informational and transactional messages, including order confirmations, shipping updates and delivery notifications. Messages may be sent using an automatic telephone dialing system or autodialer.

Consent is not a condition of any purchase. You do not need to opt in to the Program in order to buy our products or services, and the consent box is never pre-checked. You must be at least 18 years old and the owner of the mobile number you provide.

Message Frequency

Message frequency varies. You may receive multiple messages per week depending on your account activity, promotions and our marketing schedule.

Message and Data Rates

Message and data rates may apply. VitaTienda is not responsible for any fees or charges incurred by your wireless carrier for text messaging services. Please check with your mobile service provider for details regarding your messaging plan.

Opt-Out — How to Unsubscribe

You can opt out of the Program at any time by texting STOP to the number from which you received a message. After you send STOP you will receive a one-time message confirming your opt-out, and you will no longer receive marketing text messages from us unless you re-subscribe. Opting out of SMS marketing does not affect other communications you may receive from us, such as email.

Cart Reminders

If you add items to your cart and do not complete your order, we may send you a reminder text message about that cart if you have opted in to the Program. We identify the cart using your mobile number together with cookies and your session on our site (see our Privacy Policy). Every reminder includes opt-out instructions, and you cannot complete a purchase by replying to a text message — orders are completed only in our online store.

Quiet Hours

We do not send marketing text messages before 8:00 a.m. or after 8:00 p.m. in your local time zone, consistent with TCPA regulations and applicable state laws.

Supported Carriers

The Program is supported on major U.S. wireless carriers including, but not limited to, AT&T, Verizon, T-Mobile and Sprint. Carriers are not liable for delayed or undelivered messages.

Privacy and Data Sharing

We respect your privacy. We will not share your opt-in to our SMS program with any third party for purposes unrelated to providing you the services of that program, and your SMS opt-in data and consent status will not be sold to or shared with third parties or affiliates for their own marketing or promotional purposes. We may share your personal data, including your SMS opt-in data or consent status, with the vendors that help us deliver the messages (platform providers, phone companies and similar service providers). Disclaimer and Governing Law

The Program is offered on an "as-is" basis and may not be available in all areas at all times. We are not liable for any delays or failures in the receipt of text messages, as delivery is subject to effective transmission from your network operator and to your device's compatibility. These SMS Terms and Conditions are governed by and interpreted in accordance with the laws of the State of Minnesota and the United States of America, and form part of our Terms of Service.
